One Arkansas lawmaker wants to ban the hemp products that have taken over shelves at gas stations and convenience stores.
Republican state Sen. Tyler Dees introduced a bill last week that would ban the likes of Delta-8, Delta-9 and Delta-10 –– legal, but under-regulated compounds that have been known to produce a high similar to that of cannabis.
“It’s because of an accessibility issue where you can walk into a regular gas station and purchase this product as if you’re purchasing Skittles or any other candy,” Dees told local news station THV11.
Hemp-derived products have become ubiquitous in recent years, particularly following Congress’ passage of the 2018 Farm Bill, which legalized industrial hemp production.
But critics have lamented that many of those hemp products are subject to little, if any, regulation, posing risks to consumers who believe what they’re consuming to be mostly harmless.
Dees claimed to the station that poison control “is being contacted of cases where kids are, are digesting products that are causing harm to them.”
THV11 followed up with the state’s poison control, which “said that while there are no specific numbers when it comes to Delta 8 because the data didn’t start being collected until January 2021, they have been seeing an increase in kids being exposed to THC products.”
“Any THC-containing product is potentially harmful. Whether or not it’s Delta 8 or Delta 9,” Ari Filip, the medical director for Arkansas Poison Control Center, told the station. “We worry about this having psychoactive effects so it should be kept away, locked inaccessible to children.”
The state’s Republican governor, Sarah Huckabee Sanders, who was elected in the November election, voted against the proposal.
“I don’t think that with the drug epidemic that we have across this state, frankly across the country, that adding and giving more access to that does anything to benefit Arkansas, so I certainly wouldn’t be supportive of that,” Huckabee Sanders, a former press secretary for Donald Trump, said in October.
In a video last fall urging voters to reject the legalization measure, Huckabee said that “you aren’t the one who is going to be making the money, drug cartels will.”
“And if you are one of those people that can sell the drug, maybe you’ll make a buck off of the gullible people who will somehow convince themselves this is absolutely harmless,” the former governor added.
Medical cannabis is legal in Arkansas, however, and a co-sponsor of the bill to ban Delta-8 and other hemp products, state Sen. Jonathan Dismang, insisted that the measure would not affect that program.
“I mean, you have to have your card and there are benefits that are, you know, for those patients, this isn’t about that,” Dismang told THV11. “I mean, a high school kid right now can go purchase. Again, I think that’s wrong.”
Arkansas legalized medical cannabis in 2016, when a majority of voters approved an amendment authorizing the treatment.
Per the state’s Department of Health, patients with the following conditions may qualify for a medical cannabis prescription: “Cancer; Glaucoma; Positive status for human immunodeficiency virus/acquired immune deficiency syndrome; Hepatitis C; Amyotrophic lateral sclerosis; Tourette’s syndrome; Crohn’s disease; Ulcerative colitis; Post-traumatic stress disorder; Severe arthritis; Fibromyalgia; Alzheimer’s disease; Cachexia or wasting syndrome; Peripheral neuropathy; Intractable pain which is pain that has not responded to ordinary medications, treatment, or surgical measures for more than six (6) months; Severe nausea; Seizures including without limitation those characteristic of epilepsy; Severe and persistent muscle spasms including without limitation those characteristic of multiple sclerosis; and any other medical condition or its treatment approved by the Department of Health.”

Is Marijuana Legal in New Orleans?

VI. Everything might change with the 2023 Farm Bill
The 2023 Farm Bill is currently being constructed, and it is expected to bring changes to the legal status of hemp. A farm bill is an omnibus law that addresses a wide range of agricultural and food programs, and it is renewed every five years. The 2018 Farm Bill legalized industrial hemp, and the Domestic Hemp Production Program established hemp as an agricultural crop that can be eligible for USDA farm programs if it complies with USDA regulations. However, the 2018 bill did not legalize CBD for internal and medical uses, or synthetics like THC-O, which no longer fit the legal definition of hemp.
The industry has taken advantage of this confusion and created other products, such as delta-8 THC, HHC, and hemp-derived Delta-9 THC. In an email response sent to Rod Kight of Kight Law Office PC on Feb. 13, the Drug Enforcement Administration (DEA) stated that because delta-9-THCO and delta-8-THCO are synthetic and are not found naturally in cannabis, they do not count as hemp, and are therefore controlled substances.
Kight’s letter was originally sent in August 2022 (and a follow-up email sent last week on Feb. 7) with a request for the status of THC acetate ester (THCO) under the Controlled Substances Act (CSA).
Terrence L. Boos, Chief Drug & Chemical Evaluation Section Diversion Control Division penned the response, and clarified the agency’s stance on delta products. “The only substances of which the Drug Enforcement Administration (DEA) is aware of the THC acetate ester are delta-9-THCO (delta-9-THC acetate ester) and delta-8-THCO (delta-8-THC acetate ester),” Boos said. “The Drug Enforcement Administration (DEA) reviewed the CSA and its implementing regulations with regard to the control status of these substances.”
Boos explained that the CSA classifies “tetrahydrocannabinols,” or THC, as “naturally contained in a plant of the genus Cannabis (cannabis plant), as well as synthetic equivalents of the substances contained in the cannabis plant and/or synthetic substances, derivatives, and their isomers with similar chemical structure and pharmacological activity to those substances contained in the plant.”
Because of this definition, neither delta-9-THCO or delta-8-THCO are considered to be hemp by the DEA. “Delta-9-THCO and delta-8-THCO do not occur naturally in the cannabis plant and can only be obtained synthetically, and therefore do not fall under the definition of hemp,” wrote Boos.
He added that delta-9-THCO and delta-8-THCO have “similar chemical structures and pharmacological activities to those contained in the cannabis plant,” and thus meet the definition of “tetrahydrocannabinols,” which the agency classifies in Schedule I. He also included the molecular structure of delta-9-THCO and delta-8-THCO for reference at the end of the letter.
In a written statement from Michelle Bodian, a partner at Vicente Sederberg, Bodian explained what this news could mean for the industry. “While the latest statement from DEA does not clarify the legal status of all novel hemp derived cannabinoids, it does clarify that DEA believes Delta-9THCO and Delta-8THCO are controlled substances,” said Michelle Bodian, Partner at Vicente Sederberg. “Hopefully, there is Congressional action soon to address the legality of all hemp derived cannabinoids, so the industry is not left with a patchwork of law, regulation, policy and now, letter statements.”
While the government has been silent on a definitive course of action in regard to regulating delta products, state legislators have been left to take action on their own.
Delta-8 products were banned in New York in May 2021. Ohio created new rules to govern delta-8 products in June 2021, including production and sales. A new law introduced in Michigan in July 2021 also created regulations that limited the sale of delta-8 products to only cannabis businesses that were licensed by the Michigan Marijuana Regulatory Agency. Later in November 2021, a Texas judge issued a temporary injunction that removed delta-8 from the state’s list of Schedule I substances.
In May 2022, governmental agencies such as the Food and Drug Administration (FDA) sent out warning letters to businesses selling delta-8 products. “The FDA is very concerned about the growing popularity of delta-8 THC products being sold online and in stores nationwide,” said FDA Principal Deputy Commissioner Janet Woodcock. “These products often include claims that they treat or alleviate the side effects related to a wide variety of diseases or medical disorders, such as cancer, multiple sclerosis, chronic pain, nausea, and anxiety.”
In the most recent string of delta-related news, Connecticut Attorney General William Tong recently announced that his office was suing five retailers selling cannabis without a license, specifically in relation to delta-8 THC. “Cannabis products in Connecticut cannot be sold by unlicensed retailers and must meet rigorous testing and packaging requirements. Period,” said Tong in a statement. “Any unlicensed Connecticut retailer selling delta-8 THC products that purport to contain high levels of THC is breaking the law and may be subject to both criminal and civil penalties.”

The cannabis market is evolving at a rate that can quickly leave the end consumer stunned. For starters, it’s growing in size – the U.S. market, valued at $10.8 billion in 2021, is forecast to almost quadruple by the next decade, according to a Grand View Research report.
Consumer habits and opinions are changing, too. For example, a 2019 study identified a trend wherein cannabis edibles were becoming increasingly popular among non-daily users while the use of smoking marijuana was declining among both daily and non-daily users.
Finally, the legal landscape has been changing, too. With 24 states, territories, and districts allowing for legal recreational use, things are looking up for the industry. One problem with these ever-growing popular products is that the average cannabis consumer is confused by Delta 9 THC and thinks it’s Delta 8, bad, sketchy, or doesn’t get you high. All of which are false. Delta 9 THC is the same THC that cannabis consumers have consumed since the Native Americans used it.
The Florida-based company Kandy Boy is the perfect example of a cannabis company created to take advantage of all those innovations and trends. The company’s main products are Delta 9 THC gummies that contain 15mg of Delta 9 THC and High THCa Hemp Flower, which is considered hemp under federal law but has just as much Total THC in the flower as the dispensaries. Focusing on providing products that contain the THC people are used to consuming instead of having a large variety of products like Delta 8 THC companies.
Even more interesting is that the company is legally offering to ship their Delta 9 THC gummies to all 50 states. From the very start, the company found it necessary to educate the consumers on their products, the process, and the broader community they served. To be able to ship to all states legally, the company relied on the wording of the Hemp Farm Bill that stated it’s able to sell hemp-derived THC as long as it stays within the 0.3% volume threshold. The products contain significant amounts of THC – the company states the gummies contain 15mg of THC, the same THC you would get at the dispensary.
“The total amount of 100% Delta 9 THC in a gummy is less than 0.3% of the gummy’s entire weight. So that’s how we can sell these across the country, and people can buy them without having a medical card,” says Benjamin Boyce, the company founder.
Legality aside, a whole other set of explanations was required to explain the difference between Delta 9 THC-tetrahydrocannabinol, or Delta 9 THC – the type of THC Kandy Boy uses – and the increasingly popular Delta 8 THC. The two compounds might belong to the same class – cannabinoids – and contain the same elements, but they are not identical. Instead, they are isomers, molecules with the same atoms but also something different. A double bond is located between the atoms in the case of Delta 9 THC and Delta 8 THC.
In a cannabis plant, most THC comes in the form of THCa and Delta 9 THC. So much so that when we talk about THC, we mean total THC, which is THCa x 0.877 + ∆9-THC = Total THC.
It’s that dominant. The significantly less present Delta 8 THC has some different properties than its isomeric companion. It’s said to be ⅓ the strength of Delta 9 THC, but more importantly, it’s not as highly regulated.
The recent boom in Delta 8 THC products has led the U.S. Food and Drug Administration to issue a series of warning letters to companies selling Delta 8 THC products that are not in compliance. In addition, due to an uptick in complaints of adverse effects, the FDA also released a five-point information bulletin to inform the public of some essential facts about the isomer Delta 8 THC.
Among those are the fact that no Delta 8 products have been evaluated or approved by the FDA. Also, thanks to the production process required to create an adequate concentration of Delta 8 THC, the use of harmful chemicals might go undisclosed.
“The regular THC, Delta-9 THC has been extensively studied for decades, so we know an awful lot about it,” says Boyce. “There’s no such wealth of knowledge on Delta 8, not to mention how the lack of regulation opens up the room for bad actors to come in with the bad and potentially harmful product.”
Even though the extraction of Delta 9 THC from hemp might involve similar processes as the extraction of Delta 8 THC, the increased oversight over Delta 9 THC can lead to better quality products. It certainly does in the case of Kandy Boy – their products are tested at a DEA-approved facility, not just for their THC contents. As a result, customers can easily access the test results for heavy metals, pesticides, mold, and fungi.
Kandy Boy went a step further to make accessing their product as convenient as possible. However, Boyce said, “More people are buying off the truck while driving around than ordering off the app, but a lot of people see Delta 9 THC and think it’s something different, or it’s Delta 8.
